Please read these Terms & Conditions carefully before using Novaly. By creating an account or subscribing to any plan, you agree to be bound by these terms.

1. About Novaly

Novaly ("we", "us", "our") is a personalized newsletter and private podcast service. We deliver curated newsletters drawn from verified sources on topics you choose, with optional audio editions accessible via private podcast RSS feeds. The service is available in French and English.

2. Eligibility

You must be at least 16 years old to use Novaly. By subscribing, you confirm that the information you provide is accurate and complete.

3. Subscriptions & Billing

Novaly is a paid subscription service. There is no free tier. Plans, features, and pricing are listed on our Pricing page.

  • Billing cycle: monthly, charged on the date of your initial subscription.
  • Auto-renewal: subscriptions renew automatically each month unless cancelled before the renewal date.
  • Payment processing: all payments are processed securely through Stripe. We do not store your card details.
  • Plan changes: you may upgrade or downgrade your plan at any time. Changes take effect at the next billing cycle.
  • Gift subscriptions: plans can be purchased as a gift for any email address. The recipient activates the subscription independently. Gift purchases are non-refundable once the recipient has activated the subscription.

4. Cancellation & Refunds

You may cancel your subscription at any time from your account settings. Access continues until the end of the current billing period. We do not offer prorated refunds for partial months.

If you experience a billing error or are charged incorrectly, contact us at support@novaly.app within 14 days of the charge.

5. The Service

Newsletter Delivery

Novaly delivers personalized newsletters to the email address associated with your account. Delivery frequency is set per newsletter (daily, weekly, etc.). We do not guarantee uninterrupted delivery, as factors outside our control (email providers, spam filters) may affect receipt.

Audio Editions & Podcast RSS

Premium plan subscribers receive a private RSS feed URL for each newsletter with audio enabled. This URL is personal and must not be shared publicly. If misuse is detected, we reserve the right to rotate or revoke the feed.

Content

All newsletter content is curated from publicly available, verified sources. Novaly does not claim authorship of the source material. Summaries and editorial framing are produced by our service.

6. Acceptable Use

You agree not to:

  • Share your account credentials or private RSS feed URLs with others.
  • Use Novaly for any unlawful purpose.
  • Attempt to reverse-engineer, scrape, or automate access to our service.
  • Resell or redistribute content delivered through Novaly.

7. Intellectual Property

The Novaly name, logo, interface, and any original editorial content we produce are our intellectual property. Source articles remain the property of their respective publishers.

8. Privacy

Your use of Novaly is also governed by our Privacy Policy. We collect only the data necessary to operate and improve the service. We do not sell your personal data.

9. Warranty Disclaimer

The service is provided "as is" without warranties of any kind, express or implied. We do not warrant that the service will be error-free, uninterrupted, or that the content delivered will be complete or accurate. Novaly is not a news publisher and is not liable for decisions made based on newsletter content.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Novaly's total liability to you for any claim arising from use of the service shall not exceed the amount you paid in the 30 days preceding the claim.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date above and notify you by email if the changes are material. Continued use of the service after notice constitutes acceptance of the updated terms.

12. Governing Law

These Terms are governed by the laws of France. Any disputes shall be subject to the exclusive jurisdiction of the courts of Paris, France.
